Kuwait End of Service Benefits Guide 2026
Last updated: May 2026 · Legal reference: Kuwait Labour Law No. 6 of 2010, Articles 51–54
Quick Summary
Every private sector employee in Kuwait is legally entitled to end of service benefits (EOSB) after completing one year of service. The formula is based on basic salary only — not total package — and uses 15 days per year for the first 5 years and 30 days per year after that. The maximum payout is capped at 18 months of basic salary.
End of service benefits — known as EOSB or indemnity — is the lump sum payment every private sector employee in Kuwait is legally entitled to when their employment ends. For most expat workers, it is the largest single payment they will receive in Kuwait, yet it is one of the most commonly miscalculated entitlements in the country. This guide explains exactly how it works, what the law says, and how to make sure you are not underpaid.

Calculate my Kuwait EOSBWhat Kuwait Labour Law says about EOSB
Kuwait end of service benefits are governed by Labour Law No. 6 of 2010, Articles 51 to 54. The law applies to all private sector employees regardless of nationality, contract type, or length of service — as long as you have completed at least one full year of continuous employment. The law sets a minimum entitlement. Your employment contract can specify a higher amount, but your employer cannot pay you less than what Articles 51–54 specify.
The exact Kuwait EOSB formula
Step 1 — Calculate your daily rate:
Daily rate = Basic salary x 12 / 365
Step 2 — Calculate days earned:
- Years 1 to 5: 15 days of basic pay per year
- After 5 years: 30 days of basic pay per year
Step 3 — Apply the cap:
Total cannot exceed 18 months of basic salary.
Worked example
Basic salary of KWD 500/month, worked for 7 years:
Daily rate = 500 x 12 / 365 = KWD 16.44/day
First 5 years = 5 x 15 days x 16.44 = KWD 1,233
Next 2 years = 2 x 30 days x 16.44 = KWD 986.30
Total EOSB = KWD 2,219.30
Common mistakes employers make
1. Using total salary instead of basic salary
Only your contractual basic salary counts — not housing, transport, or any other allowance. If your total package is KWD 800 but your basic is KWD 400, the calculation uses KWD 400.
2. Using 30-day months instead of the annual formula
Some HR departments calculate the daily rate as basic divided by 30. The correct formula under Kuwait law is basic x 12 divided by 365. This difference compounds significantly over multiple years.
3. Applying resignation reductions that do not exist
Unlike Saudi Arabia, Kuwait law does not reduce your EOSB if you resign. Resignation and termination use identical rates. If your employer offers you less because you resigned, that is incorrect.
4. Not counting partial years correctly
If you worked 6 years and 8 months, you are entitled to EOSB for the full 6 years plus a proportional amount for the 8 months. Employers sometimes round down to the nearest full year — this is not permitted.
