Kuwait end of service benefits are governed by Labour Law No. 6 of 2010, Articles 51 to 54. Common mistakes employers make

1. Using total salary instead of basic salary

Only your contractual basic salary counts — not housing, transport, or any other allowance. If your total package is KWD 800 but your basic is KWD 400, the calculation uses KWD 400.

2. Using 30-day months instead of the annual formula

Some HR departments calculate the daily rate as basic divided by 30. The correct formula under Kuwait law is basic x 12 divided by 365. This difference compounds significantly over multiple years.

3. Applying resignation reductions that do not exist

Unlike Saudi Arabia, Kuwait law does not reduce your EOSB if you resign. Resignation and termination use identical rates. If your employer offers you less because you resigned, that is incorrect.

4. Not counting partial years correctly
